This Terms of Business sets out the terms and conditions under which we conduct our business

We are authorised and regulated by the Financial Conduct Authority. Our Firm Reference Number is 678055. We are permitted to act as a Credit Broker.

We recognise it is important for customers to be able to shop around for credit and alternative sources of credit.

Some of the services that we provide are not regulated by the Financial Conduct Authority. You will be advised in advance of any such proposal or service.

Quotations

We will quote figures based on our funders cost of funds. The funder has the right to change or decline these quotes on receipt of the full proposal.

Conflicts of Interest

If through exceptional circumstances Visionary Vehicle Company Limited or any of its Directors or other customers has a material interest in business you ask to be transacted for you, we will make you aware of the conflict of interest and we will obtain your consent before your instructions are carried out. A copy of our Conflicts of Interest Policy is available on request.

This Fair Processing Notice ('Notice') describes how Visionary Vehicle Company Limited ('we','us','our') collects and processes personal information about you; how this information is used and protected, and your rights in relation to this information. Personal Information we use

We may be required to collect certain personal information about you by law or as a consequence of the business relationship we develop with you. Failure to provide this information may prevent or delay the fulfilment of these obligations.

Information we collect directly from you

Categories of information that we may collect directly from you include your personal details (e.g. name and date of birth), contact details, transaction information and information about your associated persons, such as your spouse, partner,  any directors of your company, or other persons with whom you are financially linked ('associated persons').  If you are providing us with personal information about your associated persons, please provide a copy of this Notice to them.

Information we collect from credit reference agencies and fraud prevention agencies

We also collect personal information about you and your associated persons from credit reference agencies and fraud prevention agencies. We will search your records (and those of your associated persons) with credit reference agencies and fraud prevention agencies when we receive your application, whether or not the application proceeds.  We will also make periodic searches if your records during the life of our contractual relationship with you. Before Pre-Contract Searches are carried out by financial lenders, we may use credit scoring or automated decision-making systems to assess your application and to verify your identity.

There are three main credit reference agencies in the UK who deal with people’s personal data.  Callcredit Limited, Equifax Limited and Experian Limited.  Each is regulated by the Financial Conduct Authority (“FCA”) and authorised to conduct business as a credit reference agency.  Visionary Vehicle Company currently use Experian Limited.

How we use your personal information and the basis in which we use it 

We may use your personal information for the following purposes:

Your right in regard to your personal information 

We encourage you to contact us to update or correct your information if it changes or if the personal information we hold about you is inaccurate.  You may also have certain rights regarding your personal information. These include the right to access, rectify, erase or port your personal information. You may also have the right to restrict or object to our use of your personal information and withdraw any consents you have provided us. 

Information Sharing with third parties 

We may share personal information relating to you and your associated persons with credit reference agencies and fraud prevention agencies to help us and other organisations make decisions on motor, household, credit, life and other insurance proposals and insurance claims, for you and your associated persons, managing credit and credit related accounts or facilities and checking details of job applicants and employees. You have a legal right to obtain details of the credit reference and fraud prevention agencies from whom we obtain and to whom we pass information about you. You also have a right to further details explaining how the information held by fraud prevention agencies may be used. If you would like to obtain such information, please contact us. We may also share your personal information with our service providers, our group companies, law enforcement agencies, court, regulators or government authorities, insurers and third-party asset purchasers under certain circumstances.   

Our remuneration

We do not directly charge you for helping you arrange your asset finance facility. We are remunerated by way of an introductory payment payable by the funder. The nature of this payment and the effect on the interest rate you might pay will vary from funder to funder and is dependent upon a number of factors including (but not exclusive to) asset type, product chosen and customer circumstances and credit status.

Data Protection and Confidentiality – General Data Protection Regulation (GDPR)

We are registered under the Data Protection Act 2018 and abide by the requirements of the GDPR. The information we receive from you is used to provide quotations and arrange finance with a funder. Before or after you enter into any agreement with a funder, to help make credit decisions, the funder will make a credit search with a credit reference agency. If you are a company or partnership, they will also make enquiries about the principle director(s) or partner(s) with a credit reference agency. Full details of the use and disclosure of your information by the funder is contained within the terms and conditions of any agreement which you should read before signing.  We are required to verify your identity in accordance with the Proceeds of Crime Act 2002 (POCA) and the Money Laundering Regulations 2007.

All customers’ records are treated as private and confidential retained for 7 years and Visionary Vehicle Company Limited therefore reserves the right to give you copies of your particular records rather than allow access to files containing records concerning other clients.
